DUI

In California driving under the influence (DUI) laws are some of the most heavily charged crimes as the police and courts take enforcement of DUI laws very seriously. If convicted of a DUI, you may face having your drivers license suspended, jail time, and heavy fines.

What Are Breath Tests?

If you have been suspected of DUI, the police will require you submit to a chemical test to confirm that there are drugs and/or alcohol in your blood. In California, you have the choice of submitting to a breath test or a blood test. A breathalyzer is a breath test that measures your blood alcohol content (BAC) — the amount of blood in your system. The higher percentage of this test, the stiffer penalties you may face if convicted. For example, if the breathalyzer measures a BAC above 0.08 percent, you will face substantially more fines if convicted and it will be harder to defend the charges.

What Are Field Sobriety Tests?

Most police will attempt to have you perform field sobriety tests (FSTs) to measure your motor skills if they suspect you are drinking and driving. All field sobriety tests are voluntary, therefore you have the right to politely decline if asked to do so. There are several different types of test, such as the finder to nose test, walk in a straight line test, and the counting backward test. DUI laws regarding FSTs are very complicated and you should contact a DUI attorney. Police frequently make mistakes when conducting FSTs and an experienced lawyer will know how best to approach the case.

Remember, that with DUI's you will face penalties from the court's and the DMV. The DMV will attempt to suspend your license and/or revoke your driving privileges This is separate from what the court may require, which will likely include hefty fines, the participation in a DUI program, and possibly time in jail.
